Acabamos de ajuizar ação de revisão criminal em favor do Presidente Jair Bolsonaro no Supremo Tribunal Federal, diante da ocorrência e constatação de novos fatos, aptos a reverterem a absurda condenação havida, por maioria de votos, na 1 Turma. Os principais fundamentos que amparam o pedido decorrem: (i) da apresentação de prova nova que beneficia o requerente, consubstanciada em Parecer Técnico que identifica diversas quebras na cadeia de custódia das provas digitais (relacionadas a dispositivos eletrônicos apreendidos);  ii) da contrariedade às normas que asseguram a estrutura acusatória e o exercício efetivo da defesa, oportunamente apontada no curso da AP 2668 e agora examinada à luz das manifestações do próprio Relator na sessão de 15 de setembro de 2026, relativa à PET 16.662/DF. Importante observar que, para além das esperadas falhas na cadeia de custódia das mídias eletrônicas, as posições declaradas pelo Ministro Alexandre de Moraes durante a insólita sessão de julgamento da PET 1662/DF (“caso Master”), havida no dia 15 p.p., mostraram-se em absoluta relação de contrariedade com o quanto decidido na ação penal que condenou o Presidente Bolsonaro. Por poucas palavras: situações idênticas com posições totalmente diversas. A relação de contrariedade apresentou-se nas questões referentes à possibilidade do magistrado atuar nas investigações durante a fase de inquérito, o que pública e recorrentemente o referido Ministro fez e, passados poucos meses, agora afirma ilegal no “caso Master”.
