Silvinei Vasques merece ser lembrado como um dos mártires da ditadura judicial brasileira. Não bastasse tudo o que passou - perseguição, processo injusto, condenação absurda, fuga para o Paraguai seguida de captura e deportação -, agora a besta-fera deu o arremate final na tortura que vem impondo ao ex-Diretor da Polícia Rodoviária Federal: cassou a sua aposentadoria. O Código Penal prevê que um dos efeitos da condenação é a perda do cargo público para quem recebe pena superior a 4 anos de prisão por crime comum. Só que o Silvinei Vasques já não estava mais na ativa. Ele se aposentou ainda em dezembro de 2022. Sua situação previdenciária, portanto, já estava consolidada. Uma aposentadoria dentro da lei, concedida quase quatro anos antes dessa decisão de agora. E é justamente aí que mora o problema. A norma do Código Penal que prevê a perda do cargo, o artigo 92, I, b, fala em perda de cargo, função pública ou mandato eletivo. Ela não fala em cassação de aposentadoria, e a lei penal não pode ser interpretada em desfavor do réu ou condenado. Trata-se de jurisprudência do próprio STJ. Em fevereiro desse ano, a Sexta Turma do STJ julgou o Agravo em Recurso Especial 2.761.474, relatado pelo ministro Sebastião Reis Júnior, e fixou a tese, nas palavras do próprio tribunal: "a perda de cargo público prevista no artigo 92, inciso primeiro, do Código Penal não se aplica a agentes públicos já aposentados". E não é um entendimento novo. Já em 2016, a mesma Sexta Turma do STJ, também sob a relatoria do ministro Sebastião Reis Júnior, decidiu no Agravo em Recurso Especial 1.529.620 que o artigo 92 do Código Penal apresenta hipóteses estreitas de penalidade, entre as quais não está a perda da aposentadoria, e que, por se tratar de norma penal punitiva, esse dispositivo não admite analogia contra o réu.
