"The constitutional legal conflict is generated by two distinct but converging unconstitutional conducts by the Government of Romania: the adoption and transmission for publication of Government Emergency Ordinance no. 38/2026 after the Parliament's withdrawal of confidence through a vote of no confidence (May 5, 2026), respectively its publication in the Official Monitor on May 8, 2026, by a Government that, according to Article 110 paragraph (4) of the Constitution, was no longer authorized to carry out anything but acts of ordinary administration of public affairs, with the categorical exclusion of any delegated legislative competence; the regulation through Government Emergency Ordinance no. 38/2026 of some legislative solutions that were already in parliamentary procedure - under debate or even on the agenda of the plenary sessions in the Chamber of Deputies and, respectively, in the Senate - thus transforming the Government from a delegated legislator, who was just stripped of its democratic mandate, into a legislative authority competing with Parliament, abdicating from its constitutional role and at the same time disregarding the obligation of constitutional loyalty towards Parliament, as the sole legislative authority of the country." Sorin Grindeanu requested the Constitutional Court to acknowledge the existence of this constitutional legal conflict between Parliament and the Government and to establish the conduct to be followed in order to restore constitutional order. #Constituție #Guvern #Parlament (translated)
