Kilka dni temu zwróciłem uwagę na sposób, w jaki przedstawiano w Polsce obecność Javiera Cremadesa, przewodniczącego World Jurist Association, podczas obchodów 40-lecia Trybunału Konstytucyjnego. Kancelaria Prezydenta oficjalnie informowała, że: – Javier Cremades był gościem honorowym obchodów 40-lecia TK, – jego wizyta w Warszawie była związana właśnie z tym jubileuszem, – wydarzenie odbywało się pod honorowym patronatem Prezydenta RP, – podczas spotkania z Marcinem Przydaczem w Pałacu Prezydenckim rozmawiano https://t.co/wO8AaJDRre. o ustrojowej roli Trybunału Konstytucyjnego. Sam TK przedstawiał jubileusz jako międzynarodową konferencję dotyczącą roli Trybunału w ochronie praworządności oraz konstytucyjnych wolności i praw. W takim otoczeniu obecność przewodniczącego jednej z najbardziej rozpoznawalnych międzynarodowych organizacji prawniczych mogła być odczytywana jako forma międzynarodowego uznania obecnego Trybunału albo przynajmniej jego obecnego funkcjonowania. Nie chciałem tego zakładać. Dlatego, jako przedstawiciel ECLIR, zwróciłem się bezpośrednio do World Jurist Association z pytaniem, czy rzeczywiście tak należy rozumieć obecność Javiera Cremadesa w Warszawie. Dziś otrzymałem odpowiedź. I tutaj sprawa robi się bardzo ciekawa. World Jurist Association wyjaśnia wprost, że: – nie uczestniczyła w działaniach popierających ani obecne, ani poprzednie kierownictwo Trybunału Konstytucyjnego; – wypowiedzi Javiera Cremadesa dotyczyły ogólnych zasad niezależności sądownictwa i sądownictwa konstytucyjnego; – nie miały one na celu poparcia żadnego konkretnego stanowiska instytucjonalnego, sądowego ani politycznego; – ani WJA, ani Javier Cremades nie wydali opinii dotyczącej obecnego funkcjonowania polskiego Trybunału Konstytucyjnego; – nie przeprowadzili w tym zakresie żadnego badania ani analizy prawnej; – nie oceniali, czy obecne funkcjonowanie TK spełnia standardy niezależności sądowej, legitymacji instytucjonalnej ani praworządności. Czyli trzeba to powiedzieć bardzo precyzyjnie: obecność Javiera Cremadesa podczas obchodów 40-lecia TK nie stanowiła potwierdzenia przez World Jurist Association, że obecny Trybunał Konstytucyjny funkcjonuje prawidłowo, zgodnie ze standardami niezależności czy praworządności. Takiej oceny WJA po prostu nie dokonała. Nie twierdzę przy tym, że oficjalny komunikat Kancelarii Prezydenta wprost przypisał WJA takie stanowisko, ale sposób przedstawienia wizyty, ranga gościa, kontekst jubileuszu oraz podkreślanie jego obecności mogły tworzyć właśnie takie wrażenie. Dlatego warto było zapytać bezpośrednio u źródła. I właśnie po to istnieje rzetelna analiza instytucjonalna: nie po to, żeby dopowiadać cudze intencje, ale po to, żeby sprawdzić, co dana instytucja rzeczywiście powiedziała, a czego nie powiedziała.
