Pseudoprawnik o pseudonimie „Godzilla” już wie, że przegrał, ale wciąż gra na zwłokę i pewnie liczy na jakiś cud lub inną sytuację nadzwyczajną. W ostatnich podrygach pokazuje po raz kolejny swoje braki w wiedzy prawniczej i całkowity brak poszanowania obowiązującego prawa. Znamiennym przykładem bezprawia są jego groźby skierowane w stosunku do trojga legalnie powołanych sędziów TK, których Karol Nawrocki raczył zaprosić do pałacu na uroczystość złożenia ślubowania wobec prezydenta. W czwartek 24 września 2026 na stronie internetowej TK pojawił się „Komunikat w sprawie wszczęcia postępowania wobec trojga sędziów Trybunału Konstytucyjnego”. Czytamy w nim, że „Prezes Trybunału Konstytucyjnego Bogdan Święczkowski, działając na wniosek jednego z sędziów, wszczął dzisiaj postępowanie mogące się zakończyć zarzutami dyscyplinarnymi wobec trojga sędziów Trybunału Konstytucyjnego: Magdaleny Bentkowskiej, Dariusza Szostka oraz Sławomira Patyry.” Według tego komunikatu, postępowanie ma dotyczyć złożenia przez dwójkę sędziów zawiadomienia o niepopełnionym przestępstwie (popełnionym przez pracowników TK) oraz niewykonywania obowiązków sędziowskich. Z tekstu wynika, że Bogdan Święczkowski wydał prawomocny wyrok w sprawie dyrektorki kancelarii TK i komendanta Straży TK. Pamiętajmy, że dzień wcześniej Prokuratura Krajowa przedstawiła im zarzuty dotyczące bezprawnych działań wykonywanych na polecenie Bogdana Święczkowskiego. Oczywiście p.o. prezesa TK nie miał prawa samodzielnie orzec, że jego podwładni nie popełnili przestępstwa. Nie mówiąc o tym, że nie miał prawa orzekać we własnej sprawie. Na dzień dzisiejszy nie może być mowy o „zawiadomieniu o niepopełnionym przestępstwie”. Jeżeli chodzi o rzekome niewykonywanie obowiązków sędziowskich przez troje sędziów TK, to jest to oczywista manipulacja. Ci sędziowie pracują, analizują akta spraw, które im przydzielono, przygotowują projekty orzeczeń. Odmowa orzekania wynika wyłącznie z tego, że są istotne wątpliwości co do prawidłowości ustalania składów orzekających przez Bogdana Święczkowskiego. W tej chwili typowy, piątkowy skład to „murowana trójka” do której dobiera on dwóch sędziów jako dekorację. „Murowana trójka” to Święczkowski oraz dwóch jego ostatnich „żołnierzy”: Sochański i Piotrowicz. Na końcu komunikatu jest groźba: „Postępowanie to może zakończyć się najsurowszym orzeczeniem sądu dyscyplinarnego w postaci złożenia ww. sędziów TK z urzędu.” Ten komunikat na stronie TK to typowy fake-news, który oczywiście podchwyciła TV Republika i wiele poważnych mediów. Tymczasem: 1) Bogdan Święczkowski nie wszczął postępowania dyscyplinarnego, bo nie ma takich uprawnień. 2) W razie wszczęcia postępowania NIE MOŻE się ono zakończyć prawomocnym orzeczeniem z przyczyn formalnych, za które odpowiedzialność ponosi Bogdan Święczkowski. Opisany komunikat na stronie TK zasługuje przede wszystkim na wyśmianie za swoją niespójność i bezsensowność. Może też być powodem formułowania kolejnych zarzutów karnych w stosunku do Bogdana Święczkowskiego. Procedura odpowiedzialności dyscyplinarnej sędziego Trybunału Konstytucyjnego jest uregulowana przede wszystkim w art. 24–30 ustawy z 30 listopada 2016 o statusie sędziów Trybunału Konstytucyjnego. Bogdan Święczkowski na samym początku złamał tę procedurę. Bo prezes TK nie wszczyna postępowania dyscyplinarnego, abstrahując od faktu, że Bogdan Święczkowski nie jest legalnym prezesem TK. Na podstawie art. 27 ust. 1 prezes TK w drodze losowania wyznacza sędziego TK na rzecznika dyscyplinarnego. I tu pojawia się problem, bo losować trzeba spośród wszystkich sędziów TK, z wyłączeniem sędziego, którego ma dotyczyć postępowanie. Wszystkich sędziów TK jest obecnie 15, przy czym jeden nie złożył jeszcze ślubowania wobec Karola Nawrockiego. To, że Bogdan Święczkowski nie uznaje czworga legalnie powołanych sędziów TK to przede wszystkim problem natury karnej dla niego samego. Jeżeli nie będzie losował rzecznika dyscyplinarnego spośród wszystkich sędziów TK, ten rzecznik nie będzie powołany legalnie. To dopiero rzecznik może wszcząć postępowanie dyscyplinarne lub wydać postanowienie o odmowie jego wszczęcia. Tytuł komunikatu TK zawiera więc fałszywą informację o wszczęciu postępowania. Rzecznik najpierw wstępnie wyjaśnia okoliczności sprawy. Ustala, czy faktycznie zachodzą znamiona przewinienia. Potem wysłuchuje sędziego, którego dotyczy zawiadomienie. Wynika to z art. 27 ust. 2. ustawy o statusie sędziego TK. Jeżeli rzecznik uzna, że istnieją podstawy do prowadzenia postępowania, wszczyna postępowanie dyscyplinarne i przedstawia sędziemu zarzuty na piśmie. Ten sędzia ma 14 dni na złożenie wyjaśnień i zgłoszenie wniosków dowodowych. Zgodnie z art. 25 ust. 1 ustawy, sądem dyscyplinarnym w TK jest sam TK: w I instancji – w składzie 3 sędziów TK, w II instancji – w składzie 5 sędziów TK. I tu widzimy kolejny ogromny problem dla Święczkowskiego, bo do wydania prawomocnego orzeczenia w sprawie dyscyplinarnej potrzeba 9 sędziów TK – jednego jako rzecznika dyscyplinarnego i ośmiu do składów dwóch instancji. Tymczasem Święczkowski uznaje tylko dziesięciu sędziów TK. W każdym z trzech postępowań jeden sędzia TK miałby być sądzony, drugi będzie oskarżał i jest potrzebnych jeszcze ośmiu do osądzenia. Oczywistym jest, że w każdym postępowaniu wyłączą się sędziowie objęci tymi samymi zarzutami. Święczkowskiemu brakuje więc co najmniej jednego sędziego, żeby można było zrealizować procedurę. Dodajmy jeszcze, że w swoich bezprawnych działaniach on może w tej chwili liczyć wyłącznie na siebie oraz starego komucha Stanisława Piotrowicza i swojego zastępcę Bartłomieja Sochańskiego. Kilku sędziów powołanych w czasach PiS nie ma zamiaru „umierać za Godzillę”, więc trudno zakładać, że będą chcieli karać kogoś za uczciwość tylko dlatego, że degenerat sobie tego życzy. Bogdan Święczkowski nigdy nie był wybitnym prawnikiem, ale niewątpliwie ma świadomość tego, że jego groźby w stosunku do legalnych sędziów TK są pozbawione prawnego sensu. Bo nie o sens tu chodzi, lecz o materiał propagandowy dla TV Republika.
