Panie Pośle, skoro używa Pan określenia "kodeksowy zamach stanu", to może warto najpierw ustalić, kto właściwie od miesięcy blokuje funkcjonowanie konstytucyjnego organu państwa. Bo obraz, który Pan przedstawia, jest wyjątkowo wygodny politycznie, ale ma niewiele wspólnego z rzeczywistym stanem prawnym. Sejm Rzeczypospolitej wybrał sędziów Trybunału Konstytucyjnego. Część z nich do dziś nie została dopuszczona przez prezesa TK Święczkowskiego do wykonywania obowiązków. Święczkowski przyjął konstrukcję, według której może traktować osoby wybrane przez Sejm jako "niesędziów", ponieważ Prezydent odmówił odebrania od nich ślubowania. Tyle że art. 194 ust. 1 Konstytucji mówi rzecz prostą: sędziów Trybunału Konstytucyjnego wybiera Sejm. Nie prezes TK. Nie Prezydent. Nie Kancelaria Prezydenta a SEJM. A zatem zanim zacznie Pan opowiadać obywatelom o "szturmie", "siłowym zamachu" i "kodeksowym zamachu stanu", wypadałoby odpowiedzieć na znacznie prostsze pytanie: na jakiej podstawie prezes konstytucyjnego organu od miesięcy uniemożliwia wykonywanie funkcji osobom wybranym do tego organu przez Sejm RP? I jeszcze jedno. Wmawianie obywatelom, że mamy do czynienia z "zamachem stanu", nie powoduje, że taki zamach rzeczywiście istnieje. Powtarzanie tej samej tezy coraz głośniej, dodawanie słów "szturm", siłowy i obrona Polski również nie zastępuje wykazania faktów ani znamion czynu zabronionego. Jeżeli chce Pan używać pojęcia kodeksowy zamach stanu, to pozostaje jeszcze Kodeks karny. Art. 127 i 128 k.k. wymagają konkretnych znamion: przemocy, określonego celu oraz działalności bezpośrednio zmierzającej do zmiany konstytucyjnego ustroju albo usunięcia konstytucyjnego organu państwa. Proszę więc wskazać: kto działa, jakiego używa środka przemocy, jaki konstytucyjny organ zamierza usunąć i jakie konkretne działania bezpośrednio zmierzają do tego celu. Bo prawo nie działa w ten sposób, że najpierw polityk ogłasza zamach stanu, a potem rzeczywistość ma się dostosować do wpisu na X. I wmawianie obywatelom tych bzdur, nawet wielokrotnie, nie sprawi, że staną się prawdą. #Polska #Prawo #KulturaPolityczna
Panie Lewandowski, jeżeli już straszy Pan ludzi odpowiedzialnością z art. 128 i 231 k.k., to wypadałoby najpierw przeprowadzić subsumcję, a nie zastępować ją politycznym określeniem "siłowe przejęcie:. Po pierwsze, art. 86 ustawy o TK nie ustanawia żadnej generalnej blokady czynności organów państwa wobec Trybunału. Zawiesza postępowania przed organami prowadzącymi konkretny spór kompetencyjny. Kpt 1/26 dotyczy kompetencji Prezydenta i Sejmu związanych ze ślubowaniem sędziów TK. Nie wynika z niego zawieszenie ustawowych kompetencji Policji, prokuratury ani innych organów w sprawach pozostających poza przedmiotem tego sporu. Po drugie, przedstawia Pan obecny TK tak, jakby jego status ustrojowy był bezsporny. Nie jest. Sejm w uchwale z 13 marca 2026 r. stwierdził, że Bogdan Swięczkowski faktycznie kieruje Trybunałem jako osoba nieuprawniona, a TSUE w wyroku C-448/23 stwierdził poważne nieprawidłowości dotyczące składu TK i obsady stanowiska jego Prezesa. Po trzecie, art. 128 k.k. nie penalizuje wejścia do TK. § 1 wymaga działania w celu usunięcia przemocą konstytucyjnego organu, a § 3 – przemocy albo groźby bezprawnej w celu wywarcia wpływu na jego czynności urzędowe. Najpierw trzeba więc ustalić czyn, zamiar i sposob działania, a dopiero później kwalifikować go z Kodeksu karnego. Nie odwrotnie. Tak samo art. 231 k.k. nie uruchamia się dlatego, że pan z gory uzna określoną czynność funkcjonariusza za bezprawną. To, co Pan robi, nie jest więc neutralnym wyjaśnianiem prawa. Pzryjmuje Pan najbardziej sporne założenia ustrojowe jako fakty, pomija cały przeciwny materiał prawny, a następnie na tej podstawie buduje wizję odpowiedzialności karnej osób, których konkretnych czynności nawet jeszcze nie znamy. Kodeks karny nie służy do uwiarygadniania politycznej narracji. Najpierw stan faktyczny. Potem znamiona. Na końcu kwalifikacja. Nie odwrotnie. I jeszcze jedno, Panie Mecenasie. Pan nie występuje tutaj jako anonimowy komentator internetu. Posługuje się Pan autorytetem zawodowym adwokata i właśnie dlatego pańskie słowa mają dla odbiorców zupełnie inny ciężar. Z tym statusem wiąże się jednak nie tylko prawo do pouczania innych o odpowiedzialności karnej, lecz również własna odpowiedzialność zawodowa za rzetelność przekazu i sposób posługiwania się prawem. Jeżeli więc z nierozstrzygniętego sporu ustrojowego, spornego statusu Tk i nieznanych jeszcze czynności funkcjonariuszy buduje Pan już dziś wizję przestępstwa z art. 128 k.k., to warto pamiętać, że paragraf nie staje się prawdatylko dlatego, że wypowiada go adwokat. #Prawo #TrybunałKonstytucyjny #KodeksKarny
