Panie Przydacz, widzę, że próbuje Pan stworzyć z "dublerstwa" coś w rodzaju cechy dziedzicznej 😂 Piskorski był dublerem, więc każdy, kto po nim przyjdzie, też ma być dublerem. Proste, eleganckie i przede wszystkim bardzo wygodne 🤦‍♂️ Skąd Wy bierzecie tę logikę? Z Konstytucji na pewno nie, bo prrawo konstytucyjne niestety nie działa jak klątwa rodowa. Problem z Justynem Piskorskim nie polegał na tym, że ktoś go tak nazwał, bo nie lubił jego nazwiska albo poglądów, polegał na tym, że objął miejsce po Lechu Morawskim, który sam został wybrany na miejsce wcześniej prawidłowo obsadzone 🤷‍♂️ To jest wada pierwotna. I teraz rzecz najciekawsza: z faktu, że ktoś wadliwie zajmował określone miejsce, nie wynika, że miejsce to już na zawsze staje się miejscem dublera, którego nie można prawidłowo obsadzić. Konstytucja naprawdę nie przewiduje takiej kategorii ustrojowej. Nie ma tam "miejsca po dublerze" albo "dziedziczenia statusu dublera" 😂 Nie ma też mechanizmu, w którym wada jednego wyboru automatycznie infekuje każdy kolejny wybór dokonany już po prawidłowym zwolnieniu miejsca. Wiem, brzmi to mniej widowiskowo niż cud ozdrowienia. Ale akurat tutaj cud nie jest potrzebny, wystarczy zwykła logika prawna. Pytanie nie brzmi bowiem: „czy Berek przychodzi po Piskorskim?”. To pytanie brzmi: czy w chwili wyboru Berka istniało legalnie wolne miejsce w Trybunale Konstytucyjnym. Jeżeli tak, to cała Pańska konstrukcja kończy się dokładnie tam, gdzie się zaczęła- na efektownym, ale błędnym założeniu. A szkoda. Był taki ładny ... cud 😉 #prawo #konstytucja #polityka
