Panie Szefernaker, pobieżnie przejrzałem ten projekt i już na tym etapie mam więcej pytań niż odpowiedzi. I nie chodzi nawet o polityczną warstwę tej propozycji. Chodzi o samą jakość projektu i jego uzasadnienia. Po pierwsze, Kancelaria przedstawia rozwiązanie pod hasłem "wystarczy obniżyć marże koncernów ", a nawet jako propozycję " idealnie obniżającą ceny paliw.🤔 Tyle że ustawa nie tworzy ŻADNEJ prawnej gwarancji określonego spadku ceny na stacji 🤦‍♂️ Cena detaliczna paliwa nie jest przecież prostą funkcją jednej marży. Składają się na nią również cena surowca, kurs walutowy, podatki, koszty transportu, magazynowania, zapasów i cały łańcuch dystrybucji. Jeżeli więc Kancelaria podaje konkretną skalę przyszłego spadku cen, chciałbym zobaczyć metodologię tego wyliczenia, a nie slogan konferencyjny. Po drugie, projekt ingeruje w marże przedsiębiorców i system podatkowy, a jednocześnie istotna część wykonania tej koncepcji pozostaje po stronie Rady Ministrów i ministra finansów... Czyli Kancelaria krytykuje rząd za jego sposób ingerowania w nadzwyczajne zyski koncernów, a następnie proponuje własny mechanizm, którego kluczowe elementy i tak ma wykonywać ten sam rząd a pewnie gdy tego nie zrobi, winą obarczy się rządzących, bo przeciez pan Nawrocki chcial dobrze 🤦‍♂️ Po trzecie, jako prezes europejskiego centrum analitycznego, zwracam szczególną uwagę na zgodność projektów ustaw z prawem Unii Europejskiej. Jeżeli w uzasadnieniu rzeczywiście przyjęto, że przedmiot projektu "nie jest objęty harmonizacją prawa Unii Europejskiej ", to wymaga to bardzo poważnego wyjaśnienia. Co najmniej część regulacji dotycząca opodatkowania produktów energetycznych znajduje się przecież w obszarze prawa zharmonizowanego UE. Dyrektywa 2003/96/WE ustanawia wprost minimalne poziomy opodatkowania https://t.co/wO8AaJEpgM. benzyny i oleju napędowego 🤷‍♂️ Nie przesądzam, że proponowane rozwiązanie jest z prawem UE sprzeczne, bo nie przeprowadziliśmy jeszcze audytów. Przesądzam natomiast, że takiej kwestii nie można załatwić jednym zdaniem. Po czwarte, szczególnie zastanawia mnie stwierdzenie, że nie istnieją alternatywne środki prowadzące do osiągnięcia zakładanego celu. Istnieją. Można je uważać za dobre albo złe, ale kilka dni temu Rada Ministrów przyjęła i skierowała do Sejmu projekt czasowego podatku od nadzwyczajnych zysków przedsiębiorstw paliwowych. Zakłada on opodatkowanie 60% części zysku przekraczającej określony poziom referencyjny. To jest właśnie alternatywny model ingerencji 🤷‍♂️ Można próbować wykazać, że projekt prezydencki jest skuteczniejszy. Ale najpierw należałoby przeprowadzić takie porównanie. I wreszcie - jeśli uzasadnienie rzeczywiście stwierdza, że projekt nie podlegał opiniowaniu z uwagi na "OCZYWISTE pozytywne skutki dla polskiej gospodarki", to jest to dla mnie chyba najbardziej zdumiewający fragment całego dokumentu. Oczywistość pozytywnych skutków nie jest metodą oceny skutków regulacji 🤦‍♂️ Zwłaszcza gdy państwo zamierza administracyjnie ingerować w marże przedsiebiorcw, podatki oraz mechanizm kształtowania cen na rynku wartym dziesiątki miliardów złotych. Dlatego trochę mniej marketingu, a trochę więcej legislacji panie z Kancelarii. Bo na razie ta Kancelaria krytykuje rządowy sposób ograniczania nadzwyczajnych zysków koncernów, przedstawia własny sposób ograniczania tych samych zysków, wykonanie istotnej części mechanizmu pozostawia temu samemu zrądowi, a następnie ogłasza, że pozytywne skutki rozwiązania są ... oczywiste. Projekt ustawy powinien bronić się normą, analizą skutków i zgodnością z systemem prawa. Nie nazwą kampanii.
