Policja, kurator i sąd nie widzieli podstaw do natychmiastowego odebrania dzieci rodzicom. Mimo to, po osobistym zaangażowaniu RPD, dwoje małych dzieci trafiło do domu dziecka. Sąd nakazał ich natychmiastowy powrót do rodziców, a podjęte działania określił jako rażąco nieproporcjonalne i wskazał, że mogą nosić „wyraźne znamiona przemocy instytucjonalnej”. Rzecznik Praw Dziecka ma chronić dzieci przed krzywdą, a nie wykorzystywać autorytet swojego urzędu do wywierania nacisku na inne instytucje. Ta sprawa musi zostać dokładnie wyjaśniona. To jest absolutny dramat. Wygląda że RPD zachowała się jak mściwa arystokratka, której się zdaje, że może gnębić poddanych, bo krzywo na nią spojrzeli. Dobrze, że inne instytucje zareagowały, ale krzywda i tak została dokonana. - Rzecznik Praw Dziecka Monika Horna-Cieślak była świadkiem ulicznego incydentu, podczas którego matka szarpnęła i krzyczała na swoje dziecko, które wbiegało na ulicę. A następnie obraziła samą rzecznik, która zwróciła jej uwagę. - RPD poinformowała policję i sąd przekonując o konieczności odebrania dzieci tym rodzicom. - Ani policja, ani kurator sądowy, ani sąd nie widzieli podstaw do natychmiastowego odebrania dzieci i umieszczenia ich w pieczy zastępczej. - Mimo to dzieci trafiły do placówki opiekuńczo-wychowawczej (domu dziecka) po decyzji policjantki podjętej podczas nadzwyczajnego spotkania z udziałem RPD i Komendanta Stołecznego Policji. - Sąd nakazał natychmiastowy powrót dzieci do rodziców. W uzasadnieniu wskazał, że działania wobec rodziny „mogą nosić wyraźne znamiona przemocy instytucjonalnej” i były „rażąco nieproporcjonalne do zaistniałego zdarzenia”. - Sąd miał zastrzeżenia do osobistego zaangażowania RPD, wskazując na możliwość wykorzystania autorytetu urzędu do forsowania tezy o konieczności odebrania dzieci. - Jednym z argumentów w sprawie były dwie butelki piwa znalezione w mieszkaniu, co sąd określił jako „całkowicie chybione i wręcz absurdalne”. Dzieci odebrane rodzicom po ulicznej sprzeczce. Rzeczniczka Praw Dziecka oskarżana o nadużycie władzy, a jej biuro o mobbing. Po ulicznej sprzeczce z Moniką Horną-Cieślak trzy- i czteroletnie dzieci trafiły do placówki. Wcześniej policja, kurator i sąd nie widzieli podstaw do ich natychmiastowego odebrania. Sąd nakazał dzieciom wrócić do rodziców. Ocenił, że działania instytucji były rażąco nieproporcjonalne i mogą nosić znamiona przemocy instytucjonalnej. Zwrócił też uwagę na możliwość wykorzystania autorytetu urzędu do przeforsowania decyzji. To wygląda na patologię urzędniczą: człowiek dysponujący autorytetem państwa angażuje go w sprawę, w której sam uczestniczył w osobistym konflikcie. Cenę za tę ingerencję zapłaciły małe dzieci. Na tym problemy Biura RPD się nie kończą. Byli i obecni pracownicy opowiadali TVN24 o strachu, przeciążeniu i mobbingu. Jeden z byłych pracowników skierował sprawę do sądu. Państwowa Inspekcja Pracy potwierdziła nieprawidłowości dotyczące czasu pracy. Zarzuty mobbingu wymagają rozstrzygnięcia; rzeczniczka im zaprzecza. Osoby sprawujące tak wrażliwe funkcje powinny podlegać rzetelnej ocenie predyspozycji psychicznych i emocjonalnych do wykonywania obowiązków. Każdy wiarygodny sygnał o nadużywaniu władzy lub krzywdzeniu podwładnych powinien uruchamiać niezależną ocenę, czy dana osoba nadal powinna zajmować stanowisko. Nie jest to diagnoza Moniki Horny-Cieślak. To standard, którego powinniśmy wymagać od urzędników mających realny wpływ na życie rodzin. Prokuratura powinna zbadać okoliczności odebrania dzieci, a zarzuty dotyczące pracy w biurze muszą zostać wyjaśnione. Monika Horna-Cieślak powinna odejść z urzędu.
